Legally binding agreement governing platform access, permitted public records research, excavation damage prevention compliance, and limitation of operator liability.

1. Acceptance of Terms

Please read these Terms of Service ("Terms") carefully before accessing or using County Septic Records (countysepticrecords.com, referred to herein as "we," "us," or "the Platform"). By accessing, browsing, or utilizing any portion of this website, you agree to be bound by these Terms and all applicable federal, state, and local laws. If you do not agree to these Terms in their entirety, you are expressly prohibited from using this website and must discontinue use immediately.

2. Non-Governmental Agency Disclosure (18 U.S.C. § 912)

County Septic Records is an independent, privately operated public records directory and educational research publisher. We are not affiliated with, operated by, or endorsed by any municipal health district, county clerk, state environmental agency, or the federal government. All records indexed on this platform represent public domain information assembled under state open records laws and the Freedom of Information Act (FOIA).

3. Mandatory Excavation Safety & "Call 811" Notice

Underground excavation poses severe, life-threatening hazards. You agree that under no circumstances will you rely upon permit sketches, as-built drawings, or parcel diagrams indexed on this website as substitute utility locate surveys.

  • Before initiating any mechanical digging, trenching, post-hole digging, or foundation work, you must call 811 (or submit an online 811 locate request) at least two to three full business days in advance to have all public underground utility lines (natural gas, electrical conduits, communications, water, and sewer) physically marked.
  • Septic drawings are historical schematic estimates and do not depict underground power lines, gas piping, or unpermitted modifications made by previous owners.
  • Striking underground facilities can result in fatal explosions, electrocution, massive property destruction, and strict civil and criminal financial penalties under state damage prevention statutes.

4. No Professional Engineering, Sanitarian, or Legal Advice

All content, technical diagrams, setback tables, maintenance schedules, and replacement cost estimates provided on this site are for general educational, preliminary research, and informational purposes only. Nothing on this website constitutes:

  • Certified professional engineering, civil engineering, or land surveying advice.
  • A certified environmental health inspection, percolation test, or soil evaluation.
  • A formal real estate warranty regarding property condition, zoning compliance, or escrow readiness.

Users must retain a licensed Onsite Wastewater Treatment System (OWTS) professional, registered sanitarian, or licensed engineer before purchasing property or commencing construction.

  • Your reliance upon any public record, permit sketch, or article published on this website;
  • Your failure to call 811 prior to physical excavation; or
  • Your violation of any third-party rights or applicable federal, state, or municipal laws.

8. Permitted Use & Prohibited Conduct

You are granted a limited, revocable, non-exclusive license to access and search our public directory for legitimate homeowner, contractor, municipal research, and real estate evaluation purposes. You expressly agree not to:

  • Engage in any activity that overburdens, damages, or impairs server infrastructure or disrupts service to other legitimate users;
  • Transmit or introduce viruses, trojans, worms, or other malicious software;
  • Attempt to gain unauthorized access to our server administrative environments, database servers, or private API endpoints;
  • Use the directory in violation of the Computer Fraud and Abuse Act (18 U.S.C. § 1030) or any other applicable cybersecurity law.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these Terms or the website shall be instituted exclusively in the competent courts having jurisdiction.

10. Modifications to Terms

We reserve the right to revise or replace these Terms at any time in our sole discretion. Any changes will become effective immediately upon posting to this page with an updated "Last Updated" date. Your continued use of the website following the posting of revised Terms constitutes acceptance of those changes.
